Re: WCAB Case No. WCK 0033454

California Workers’ Compensation Law is in violation of the 14th Amendment to the United States Constitution and Article 1, Section 7(a) of the State Constitution. I am being denied equal protection under the law. No one has argued this point. This Constitutional breach involves two legal disciplines, Workers’ Compensation and Civil Rights.

The accompanying documentation, listed on the next page, outlines the formal steps I have taken in an attempt to address this apparent fact.

The amended order denying petition for removal (case No. WCK 33454) of January 20, 1998 states: "The WCAB is without power to declare a statute unconstitutional; the Board must comply with the statute until an appellate court upholds a constitutional challenge. (Greener v. Workers’ Comp. Appeals Bd. (1983) 6 Cal.4th 1028, 58 Cal.Comp. Cases 783, 798.)

I pray that the District Court of Appeal declare unconstitutional those statutes that deny me equal protection under the law.

Respectfully,

Charles R. Engel

Compensation in California. Workers Compensation appears to be in a sad state and is in need of immediate reform.
