RE: IS WORKERS COMP. IN VIOLATION OF THE 14TH AMENDMENT TO THE U. S. CONSTITUTION?
Dear Senator Lockyer:
This letter is in further reference to our correspondence of June 13, 23 and my recent letter of October 17, 1997.
The attached Summary of Hearing is in reference to the Subpoena Duces Tecum of March 6, 1997 that I served on United Parcel Service and Liberty Mutual Insurance relevant to my case. The referred to subpoena will be found in the document binder I will leave at your Hayward office later this week.
My move to declare unconstitutional the Labor Code sections and other provisions governing workers’ compensation, which result in my not being able to obtain an attorney, is addressed at the beginning of the Summary of Hearing document.
I filed the referred to petition (page 2, lines 3, 4 and 5 of the summary) on October 15, 1997 and you should have already received a copy.
Regardless of the decision of the Workers’ Compensation Board or the courts, legislative remedy is absolutely necessary to even the playing field.
