Dear Mr. Naddy:
I am in receipt of your letter dated October 2, 1997 regarding Chuck Engel's access to UPS property.
Your letter claims that Chuck did not notify his supervisor before engaging in steward activities. This is not true, when he got to the UPS facility he did notify his supervisor. He was there at a reasonable time, and had no intention of interrupting the company's operations.
Further, the points you bring up in this letter are the same ones you brought up at the grievance hearing which resulted in the decision of the Panel, wherein it states that the company is to comply with ARTICLE'S 4, and 37, of the UPS Master. It did not say that the company and Mr. Engel were to comply. Why, because Chuck did comply with ARTICLE'S 4, and 37, that's why. The facts of that case are exactly the same as the one that resulted in your latest disregard for the decisions of the grievance procedure. A procedure that the last time I looked was signed by the company, a procedure that was agreed upon by both parties to peacefully resolve disputes.
Maybe we should go back to the days when, if the company did not comply with a majority decision of the Panel the Union had the right to take economic action against that company. However, that is not the case, and I am left with the option to file in a court of law to enforce the decision of the Panel. You will be hearing from our attorney’s.
