RULES AND REGULATIONS
Shop Steward
Brotherhood of Teamsters and Auto Truck Drivers
Local 70 of Alameda County (Adopted 1973)
PREAMBLE
The Steward is an elected working member.
Alternate stewards are elected also, except on a temporary basis to allow
for regular stewards absence. All shifts shall elect their own stewards.
The steward's duties as a representative of the Union on the job shall
be to see that the members of the Union at his particular terminal or place
of employment observe the agreement and at the same time that the rights
and interests of such members of this agreement are protected.
He shall receive all grievances, disputes, and shall answer questions pertinent
to the union contract he is enforcing; together with rules, regulation
and by-laws of the local union. He shall see that the contract is adhered
to not only by members, but also the employees as well.
He shall see and determine that none but local union members and authorized
persons are working on the job in reference to and according to the provisions
of the contract and agreement.
He shall give counsel to members by advising them of the services and opportunities
the union offers outside the contract and agreement.
He shall endeavor at all times to create conditions and maintain harmonious
co-worker relationship; at all times conduct himself in such a manner as
to set a good example for all members. The shop steward is the key to building
a strong democratic labor movement. At no time shall these rules be misconstrued
by a steward, individual or persons to their benefit and empower them with
irregular, dictatorial or authoritative advantage over others.
It is with these responsibilities and duties in mind that we give prestige
and dignity to the shop steward, and have set forth these rules and regulations:
SHOP STEWARD RULES
Rule 1. It shall be the duty of the shop stewards to check
the dues books, or card, of all new and regular employees periodically.
All platform referral slips are to be collected by the steward; all lumper
slips are to be turned in to the steward.
Rule 2. When a member has a complaint or grievance he must
first notify the steward of his intent and actions. If the action he follows
is contrary to these rules the member shall be subject to citation. No
steward under any circumstance working under the contract of Local 70 shall
in any way enter upon a private agreement with an employer or representative
of the employer.
Rule 3. When a member has a complaint or grievance he shall
accompany the shop steward if necessary (in a definite manner) in to the
office for adjustment. If the member is dissatisfied with the adjustment
he shall notify the steward of his discontent and request that he be given
a complaint sheet containing two copies. After filing out the forms, he
shall keep one (1) copy, return one (1) to the steward and request that
the business agent be contacted over the complaint and dissatisfaction.
At no time is the member to contact the Business Agent for a grievance
or complaint without first notifying, if possible, the shop steward and
file a written complaint sheet as to the complaint or grievance.
Rule 4. The shop steward shall report any contract violation
to the Business Agent immediately and shall receive a reply as soon as
possible, not to exceed 72 hours. All officials and agents shall adhere
to this policy.
Rule 5. No shop steward shall be removed
from the job of shop steward unless he has charges preferred against him
in writing and signed by the member or members making such charges. The
shop steward shall then be notified in the manner prescribed by the local
by-laws by the Secretary-Treasurer to appear before the Executive Board.
No steward shall be removed from the job until charges have been proved.
Rule 6. All shop stewards are obligated to attend shop steward
meetings. If the shop steward is unable to attend a shop steward's meeting
he must select a substitute to attend for him for that particular meeting.
The regular meeting for shop stewards shall be the third Tuesday of each
month. The Secretary-Treasurer shall notify the shop stewards of any special
shop steward's meeting.
Rule 7. Each terminal (place of business and employment)
or area and district where jurisdiction of local union of teamsters prevails
over and/or in connection with the jurisdiction of the local union shall
have a Chief Steward and an alternate elected with the ratification of
each new contract. The Business Agent shall be present at these elections
and shall hold such elections within sixty (60) days after contract acceptance.
In the event that no member accepts the steward's nomination in the terminal,
the agent shall appoint a steward. All shifts shall vote for the Chief
Steward. If elected a Chief Steward, he/she may only hold one steward's
position. In the event the Chief Steward position is vacated the present
stewards may run for the position of Chief Steward without resigning their
present position.
Rule 8. Any member of Local 70 who ridicules, provokes or
harasses the shop steward in any manner so as to make him appear in the
light of disrespect or is injurious to the position he holds shall be immediately
cited before the Executive Board.
Any member other than a member of Local 70 who is charged with the same
action as above, will be immediately reported to his respective union to
appear as to the request.
Rule 9. All stewards at terminals (place of business and
employment) or area and district where jurisdiction of the local union
of teamsters prevails over and/or in connection with the jurisdiction of
the local union shall (a) have a distinguishable badge with print that
will signify that he or they are a teamster's steward recognized by the
local union and employers where he is employed; (b) the shop steward will
have distinguishable identification card signifying and registered with
name and number as to his position recognized by the local union and employers
where he is employed.
No steward shall suffer a loss in pay if required by the Executive Board
to participate in litigation or participation at his own time for the union.
The rate of compensation for such activities shall be at the applicable
rate of pay of the contract the respective steward is working with and/or
area wage or rate not to exceed 8 hours pay per day.
POSTING
These rules area to be posted on Employee's Bulletin Board. Any
member marring or defacing these Rules and Regulations shall be subject
to citation.
IGNORANCE OF THE LAW IS
NO EXCUSE
UNION MEMBERS
It is the duty of all members to read these
rules as they will be strictly enforced.
