Dear Marty:
This letter is in response to your correspondence
of December 18, 1997. I have listed below my comments
on the pertinent issues under discussion.
I did not resign as shop steward. Your letter
of 8-17-95 did not confirm a resignation and it is not
self-explanatory. Your letter of 8-17-95
left the issue unresolved. You stated in that letter; "We will discuss
your status as shop steward at a later date." The referred to discussion
never took place. Your letter of 6-28-96
was the first semi-formal notification of my removal from office after
our initial correspondence. You didn't formally notify my co-workers or
my-self of my removal for over a year.
Again, I did not resign. You removed me from office on the pretense that
I resigned. Robert Alameda was appointed to replace me, by you, over the
concerns of a number of my co-workers. You repeatedly promised the rank
and file an election only to delay it under one guise or another.
Thank you for pointing out the typographical error in my
letter of 12-15-97. You are obviously familiar with the
National Labor Relations Act (NLRA). The NLRA language I quoted in my letter
was correct, however, it referred to Section
159 (a) of the NLRA rather than Section 9 (a). Your correspondence
clearly shows that you have condoned numerous violations of the NLRA much
to the detriment of the rank and file.
Why is it that Local 70 doesn't inform the workers of their legal rights
under the NLRA? The dissemination of information promotes honesty and competence.
