Daniel Dugar
Oakland, CA 94606

Dear Mr. Dugar:

I am in receipt of a copy of your letter dated August 27, 1997, to chuck Mack, regarding myself and Shop Steward Warren Evans, about alleged incidents, and your misrepresentation of the facts, so it is appropriate that I respond to the portion of the letter that applies to me.

First of all, I did not threaten you, I said I was contemplating taking action against you pre my letter dated March 31, 1997, which is self-explanatory, and a copy is attached, not because of a steward you requested, that is not the truth!

Let me make it really clear, Warren Evans is the shop steward, he does an outstanding job representing the members at UPS and he is one of the most honorable people I know, and he should be canonized for putting up with your insults and threats! I have discussed the incident of July 3, 1997, with Warren and other witnesses, and your version of the incident is not factual! You were taken into the office because you had removed freight from your truck on your own, you made no request to havae Kim Marchant attend this meeting. Let me refresh your memory, I told you I had no problem with Kim attending any meeting as long as Warren was present, again you did not make a request to have Kim at the meeting.

You have been in meetings before on the same issue of taking freight off of your truck without Management's approval, you know it is wrong and you continued to do it. Then, after the meeting, you wanted to know what the Union is going to do about it when you already know the answer! Which is, take the problem to Management, have them correct it, if they don't reduce it to writing and turn it over to the Union, then do the best job you can following the contract as you are paid to work by the hour!

After the meeting, you went off on Warren Evans, who stayed in control. You were screaming that he was "less than a man," "weak," etc. The only thing he said to you was "your mama."
You were out of control when you were threatening Warren, which was witnessed by several of your co-workers. The company was the one that threatened you with discharge and calling of the police because of you actions, not Local 70's. I am curious as to what you meant that you "heard of people dying because they insulted someone's mother!"

Teamsters Local 70 will continue to represent "all" of its members in an aggressive manner, but we will also tell someone when they are wrong! Myself, as elected business agent, and Warren Evans, as shop steward, will continue to represent you and all of the members working in the Broadway Center. Warren Evans and I are as ethical as you get, I think you need to look in the mirror and clean up your act and learn how to tell the truth.

Fraternally,

Marty Frates
Business Agent
