Dear Kim:

Please be advised that I am in receipt of a copy of a letter you sent to Chuck Mack, dated July 16, 1997(corrected from July 17, 1997), since in concerns me, I feel it appropriate I respond because it is in not accurate and nonfactual.

First of all, you were appointed as an alternate shop steward at the request of Shop Steward Warren Evans! I have stated, "What matters is that we are here for the members." You have taken that out of context. I was simply making a statement when I appointed you, since I knew we had differences of opinions on Local and National Union issues and that it did not make a difference because, "What matters is that we are here for the members!" I do not have a problem dealing with confident, self motivating, competent members, in fact, I encourage their help.

Your reference regarding my position on Employees Designation of Personal Physician form is not accurate. The forms have been distributed at UPS for years, and I would not turn down your offer to help in that area, and also, with the Family Medical Leave Act. I have not argued with your coworkers about your status as an alternate shop steward, I explained it to you and you seemed to accept it until I received a copy of the letter you sent Chuck Mack. You have not been obstructed in the attempt to educate your coworkers, that is simply not true! Teamsters Local 70 has had seminars, membership meetings, steward meetings, etc. for years and I do not remember you attending very many of them. Your remark about the NAACP law suit is not accurate at all! What I have repeatedly said was, if there is discrimination, I want to know about it, I want it reduced to writing, and Local 70 will aggressively take it on. I have also stated that some of the issues that have been brought up regarding discrimination have no merit based on the facts as I know them! I resent your charge, if you were so affected by what I allegedly said, why didn't you say something at the time, instead of waiting six (6) months!

Your charge that I told the Company not to meet with you is not true, you have not discussed this with me, the first time I heard about it was when I received a copy of your letter to Chuck Mack. Your charge that you were demoted is not true, you started as an alternate steward and you are still one. Your charge about filing grievances is not true. I have not restricted anyone from filing a grievance and none of the shop stewards I work with need permission to file a grievance. Your charge that I have conspired with management to keep you out of meetings is not true, what I have been made aware of was that you went into a meeting that I was on my way to, the Company asked you to leave and you left! You never said a word to me about it, I found out when I read the letter you sent to Chuck Mack. For your information, I have terminated meetings when the Company asked that stewards leave, all you had to do was ask and you could have attended the meeting. You failed to do so. Your charge that I refer to you as "Kim Who" is not true!

I am the elected Business Agent at UPS and I will continue to represent the membership in the aggressive manner that I have throughout the years. The stewards I work with represent the interest of the members and they do a good job. The key thing between us is that we communicate, we agree, we disagree, we respect each other, and finally, the most important thing is we talk to each other and we are loyal to each other. I would not trade this relationship for anything. You are welcome to join anytime! But in the meantime I am removing you as an alternate steward because of your failure to communicate, to work within the stewards system, and unfair criticism of other stewards and myself. In addition, I am contemplating taking legal action against you for the untrue and slanderous remarks you have made.
