California Worker's Compensation Law
Challenged for Constitutionality

Oakland, Ca. - 2/27/98 - A true David vs. Goliath Story. Charles R. Engel, a Local 78 Teamster Car washer at United Parcel Service, without the aid of an attorney has filed a Petition for Writ of Review with the State of California Court of Appeals, First Appellate District. California Law denies him the right to adequately pay an attorney for his worker's Compensation Claim filed on September 12th of 1996. "I tried to hire an Attorney but they all want to be paid. My case is somewhat complicated and the Law only allows me to pay an attorney 12% of the final settlement. The law prohibits me from paying the difference," said Mr. Engel. "On the other hand United Parcel Service and Liberty Mutual Insurance are allowed to hire as many attorneys as they can afford to protect themselves. This Law is a flagrant violation of the 14th Amendment of the United States Constitution. This law denies California workers equal protection under the law. This injustice affects every working person and their Families in the State of California."
