Dear Kenneth Ko:

Please be advised that Local No. 78 respectfully requests that UPS be cited for violating the NLRA (Case #32 CA 15881-UPS) by denying access to our Shop Steward, Chuck Engel to the property in Oakland.

This case was deferred to the grievance panel. The grievance was heard in September 1997, and a motion was made, seconded, and carried, "based on the facts presented, the Company is instructed to follow all provisions of Article 4, and 37 of the UPS Master Agreement," (see attached). Some time after this decision, Chuck attempted to enter the property, but was summarily denied access. This is in direct violation of the Grievance Boards decision. We have since resolved this issue, and Chuck Engel has been given his pass, and access.

Having said all of this, it is imperative that UPS be cited.
