Dear Mr. Ko:

This letter is in response to the your correspondence February 26, 1997. In regards to your letter to me;

1. I accepted the settlement of the grievance filed over the discharge letter of July 15, 1996 while under duress and without admitting guilt. I did this after Dan Varela was assured by an attorney that I would be able to pursue the matter. Please consider this to be a formal request to simply hold the charge without acting on it until either Local 78 can get a clarification from the mentioned attorney or item #2 is addressed.

2. I am still concerned about the discriminatory application of unwritten company policies "under special circumstances". This is my underlying concern and a primary reason I have filed these charges. United Parcel Service has refused to state their position in writing as to whether or not these policies exist on paper and or acknowledged that they exist in application. I believe that this is a reasonable request that would result in the resolution of item #1.
 

3. UPS has not yet responded to the information request that was filed on November 22, 1996 (copy attached) pertaining to the jurisdictional airport grievance. This grievance has not been resolved in over six months. I have attached an amended request for information relevant to this grievance.

4. I have not yet decided on my course of action pertaining to Mr. Naddy's refusal to allow me to attend an off premises panel meeting. I am contemplating the filing of a grievance and a subsequent information request.

As a matter of record I am not on workers' compensation at this time. I have appealed my workers compensation denial. My state disability was recently reinstated after I appealed.
