Dear Mr. Naddy:
I was escorted off company property today, at 4:00 p.m., by Automotive Manager, Mike Sousa and Automotive Supervisor, Adolph Sanchez. My identification pass was confiscated.
I informed both Mike and Adolph that I was investigating a grievance relevant to the discrimination complaint that coworker Tony Holloway has filed with the NAACP. I reminded Mike and Adolph that the discrimination complaint had been filed against both of them. I pointedly informed both Mike and Adolph that I believed their actions were illegal. Mr. Sousa acknowledged that I was not in violation of the contract. Mr. Sousa told me that he was acting on your instructions. Your actions have impeded a legitimate investigation of a discrimination grievance.
I am currently off work for discrimination related stress. I am continuing to pursue my duties as a shop steward with the approval of my industrial medicine counselor, Dr. Heckman and Local 78. My therapy consists of dealing with work related problems. I intend to continue functioning in my duties as shop steward until those I represent decide otherwise.
In the absence of violent or abusive behavior, by a steward, an employer commits an unfair labor practice and violates section 8(a)(3) of the National Labor Relations Act by refusing to meet with a steward. Unions pick their representatives, not management. Union choices must be respected.
This letter is a formal demand that you inform me in writing of the company policy or contract violation which necessitated the decision to have me expelled from company property. These actions indicate additional cause to question statements made by Labor Manager, Kim Muniz, relevant to correspondence from Local 78 and myself (copies attached). If no answer is forthcoming, I will assume that this is another implementation of an illegal secret company policy and another discriminatory incident of harassing a union steward.
