12-06-96 – Tony Holloway Discrimination Complaint

This discrimination complaint pertains to instructions that I was given by Automotive Manager, Mike Sousa, and Supervisor, Adolph Sanchez. These instructions were directed at myself only and were not given to any of the other car washers that I work with. I am the only black car washer.

I was told on 11-26-96, shortly after 7:00 a.m., that I was not to take my breaks outside of the lunch room. A white coworker, John Steeley, was standing next to me at the time I was given these instructions. He was allowed to continue taking his breaks anywhere he wished to.

I have been repeatedly told to punch off the time clock at the end of my eight hour shift regardless of whether there is additional work to be done. My Supervisor, Billy Davis, has repeatedly asked me to work additional overtime only to have his requests denied or limited by Mike Sousa and Adolph Sanchez. I am not aware of a valid reason to deny me overtime. All other employees are allowed to work overtime. Even those with less seniority than me.

I have lost a considerable amount of income as a result of these discriminatory actions on the part of management. I am able to provide additional information in regards to these unfair labor practices upon request.

Name of Employee: Tony Holloway, 3900 Harrison Street #104, Oakland, California 94611.

Explanation of Incident or Violation: This is an ongoing grievance. I have been instructed on numerous occasions by Automotive Manager, Mike Sousa, and Automotive Supervisor, Adolph Sanchez, to punch off the clock at the end of my shift regardless of the work load. This has happened repeatedly since September 13, 1996. Please refer to the attached document which is a copy of a complaint I am filing with the Oakland Chapter of the NAACP.

Relief Sought: I request that I be paid, at the overtime rate, for all hours of overtime that I was denied.
